Collection of information

Validatrium collects information to provide better services to its users and to better understand the visitors to its websites and what content is of interest to them. Validatrium collects information in the following ways:

— information you affirmatively choose to submit to us (such as your name, email address, company name, title, country) for the purpose of accessing various downloads, viewing specific content, subscribing to Validatrium newsletters, registering for events and your preferences in receiving marketing from Validatrium and its third party partners and your communication preferences, etc. Information we have obtained about you from publicly available sources such as social media, marketing platforms or on events, you attended. You will receive marketing communications from Validatrium if you have requested information from Validatrium or you or your employer has purchased services from Validatrium;

— information Validatrium receives from your use of Validatrium websites, such as the IP address, browser type, ISP, referring/exit pages, platform type, date/time stamp, number of clicks, domain name and country/state of all visitors to Validatrium’s websites; location information when you use Validatrium’s websites as Validatrium may collect and process information about your location. Validatrium use various technologies and tools to determine location;

— information that is considered aggregated data such as statistical or demographic data which Validatrium may use for any purpose. Aggregated data may be derived from your personal information but is not considered personal information in law as it does not directly or indirectly reveal your identity, unless Validatriumcombines or connects aggregated data with your personal information so that it can directly or indirectly identify you; Validatrium collects technical data from various third parties and public sources as, such as: analytics providers, advertising networks, search information providers

Other than as required by law, Validatrium websites do not collect any special categories of personal information about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). Validatrium will not collect any information about criminal convictions and offences.

Validatrium will only use your personal information for the purposes for which it was collected, unless it reasonably considers that it needs to use it for another reason that is compatible with the original purpose. If Validatrium needs to use your personal information for an unrelated purpose, Validatrium will notify you and explain the legal basis which allows Validatrium to do so.

Sharing of information

Validatrium may disclose your personal information to the following categories of recipients:

— to its group companies, professional advisers, third party services providers and partners who provide data processing services to Validatrium (for example, to support the delivery of, provide functionality on, or help to enhance the security of Validatrium websites), or who otherwise process personal information for purposes that are described in Privacy Notices or notified to you when Validatrium collects your personal information. — to any competent law enforcement body, regulatory, government agency, court or other third party where Validatrium believes disclosure is necessary (a) as a matter of applicable law or regulation, (b) to exercise, establish or defend its legal rights, or (c) to protect your vital interests or those of any other person. to any other person with your consent to the disclosure.

Legal basis of processing

If your personal information is protected by EU data protection law, Validatrium’s legal basis for collecting and using the personal information described above will depend on the personal information concerned and the specific context in which Validatrium collects it.

However, Validatrium will normally collect personal information from you only (a) where it needs the personal information to perform a contract with you, (b) where the processing is in its legitimate interests and is not overridden by your rights, or (c) where it has your consent to do so. In some cases, Validatrium may also have a legal obligation to collect personal information from you or may otherwise need the personal information to protect your vital interests or those of another person.

Use of information

Any information collected by Validatrium will be done in accordance with this Privacy Policy for the purposes of making better business decisions, supporting the activities you choose to engage in, and providing higher quality solutions and services to Validatrium’s customers. Validatrium uses your location information to tailor your experience with Validatrium websites. It may also use any non-personal information collected to enhance Validatrium websites, and your IP address for website diagnostics and administration. Validatrium will only retain your personal information for as long as necessary to fulfil the purposes it was collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal information, Validatrium considers the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorised use or disclosure of your personal information, the purposes for which Validatrium processes your personal information and whether it can achieve those purposes through other means, and the applicable legal requirements.

International transfers

Validatrium processes information on servers in many countries around the world and you consent to your personal information being processed on a server located outside the country in which you reside. These countries may have data protection laws that are different to the laws of your country (and, in some cases, may not be as protective). However, Validatrium has taken appropriate safeguards to require that your personal information will remain protected in accordance with this Privacy Policy, including, utilizing the European Commission’s Standard Contractual Clauses for transfers of personal information between its group companies, which requires all group companies to protect personal information being processed from the European Economic Area to an equivalent standard to that required under European Union data protection law.

Information security

Validatrium protects your personal information in the same way that it protects its other confidential information, such as storing it on secure servers that only select Validatrium personnel have access to, and by encrypting it to help prevent access by any unauthorized parties. Validatrium has put in place procedures to deal with any personal information breach and will notify you and any applicable regulator of a breach when legally required to do so.

Marketing

As explained above, Validatrium will collect and use your personal data for marketing purposes. Your data will be stored in our CRM system. We will use your data to inform you about Validatrium products and services we think may be of your interest and sending you our newsletters. For statistical purposes, we will collect information about your response to our emails and our interaction with you to make decisions on future marketing.

Links

Validatrium websites contains links, plug-ins and applications to various third-party websites. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. Validatrium has no control over, and is not responsible for the content, privacy policies or reliability of such third-party connections. When you leave Validatrium’s website, Validatrium encourages you to read the privacy notice and privacy policy of every website you visit.

Your data protection rights

If your personal information is protected by EU data protection law, you have the following data protection rights which you may be able to exercise by contacting Validatrium using the contact details provided under the “Contact Details” heading below and in the right-hand side column:

— If you wish to access, correct, update or request deletion of your personal information, you can do so at any time by contacting Validatrium.

— In addition, you can object to processing of your personal information, ask Validatrium to restrict processing of your personal information or request portability of your personal information by contacting Validatrium.

— You have the right to opt-out of marketing communications that Validatrium sends you at any time. You can exercise this right by clicking on the “unsubscribe” or “opt-out” link in the marketing emails Validatrium sends you or by using the relevant opt-out mechanism for non-email-based marketing.

— Similarly, if Validatrium has collected and processes your personal information based on your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing Validatrium conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.

— You have the right to complain to a data protection authority about Validatrium’s collection and use of your personal information. For more information, please contact your local data protection authority.

You will not have to pay a fee to access your personal information (or to exercise any of the other rights). However, Validatrium may charge a reasonable fee or refuse to comply with your request if your request is clearly unfounded, repetitive or excessive. Validatrium tries to respond to all legitimate requests within one month. Occasionally, it may take longer if your request is particularly complex or you have made a number of requests. In this case, Validatrium will notify you and keep you updated.

Cookies

You can set your browser to refuse all or some browser cookies, or to alert you when websites set or access cookies. If you disable or refuse cookies some parts of Validatrium websites may become inaccessible or not function properly. Terms and Conditions

Please read the following Terms and Conditions (“Terms of Service”, “Terms of Use”, “Terms”) thoroughly before entering into client-service relationships with the validatrium.com (“Service”). Validatrium (“Validatrium”, the “Company”, “Service”, “Platform”, “Us”, “Our”, or “We”), by and through validatrium.com (the “Website”), which is running, hosting, providing staking services via validating nodes across different blockchain networks.

Once an individual and/or company accesses the Website, starts using the Website functionality or any other Validatrium Service, but not limited to, providing or submitting any information to Us, an individual is consent and agrees with these Terms of Use.

Any User of the platform (“Client”, “User”, “Individual” or “You”) gives an agreement to stay compliant with these Terms of Use and other policies, procedures or rules imposed by the Service. Moreover, Terms and Conditions, as well as other policies, procedures, or rules, are subject to change and the Company leaves itself the right to modify them without noticing its Clients. In case you do not agree with these Terms and Conditions, you are restricted to view or use the Website or Validatrium services.

Regulatory Compliance

You, as a Client, must warrant and represent that your Service usage will stay compliant with all applicable regulations and laws. You are completely responsible for understanding whether or not the Validatrium Service is suitable for you in respect of such data privacy laws and regulations as GLB, HIPAA, GDPR, similar or any other applicable laws. In case you use Our Service and you are the subject to the aforementioned laws or regulations, then the Validatrium is not liable if the Platform does not meet those required criteria.

Moreover, you take complete responsibility for any other laws and regulations in your jurisdiction whether they restrict or allow you to use such services as Validatrium. Validatrium is not liable for any of your actions that violate your laws in your jurisdiction through the usage of the Service.

Ownership and Intellectual Property

The Validatrium owns all proprietary rights in the Service which include the domain (validatrium.com), such marketing materials as logos, color schemes, design, and also, but not limited to, copyrights, trademarks, trade secrets, service marks, development practices, proprietary software, and other intellectual property rights. You as a Client is obligated to respect all intellectual property of the Validatrium mentioned above, which are protected by law.

Use License

You are allowed to use our Service as it is provided by the Validatrium, without any modifications to the software or the Service that we provide. It’s restricted to modify any software created by Our Company without any prior notice, and it’s also restricted to extract and use source code which was created by the Validatrium.

You shall not perform any unlawful actions against the Company, that may create a huge load on our infrastructure interfering the normal work of the Company; attempt to bypass or circumvent any security mechanisms, gain unauthorized access to any type of our computer systems, conduct any activities that may disrupt the work of the Company, run malicious code such as worms, trojans, cryptojacking software and other types of the viruses against the Company, including, but not limited to, computer networks or computer systems.

It’s also prohibited to launch any software (“crawlers”, “spiders”, “auto-responders”) or devices on the Company, that will automatically or manually collect any data on the Website, or will spam on the Company. The “Use License” automatically voids in case an Individual violates the aforementioned rules, and shortly his/her account gets suspended. In case a User or any other individual has damaged any part of the Service due to any type of the cyber attack, then this case will be reviewed and provided to Law Enforcement, which will act accordingly in this situation.

Validatrium's Service Provision and Termination

The Validatrium provides Staking services to Client using validating nodes. The Company chooses by itself the necessary hardware and network requirements to provide a stable and efficient Staking service to Clients.

Validatrium holds responsibility for server maintenance, new hardware installation, or any server upgrades, software updates and covers all costs associated with these types of operations.

Validatrium conducts revenue share payments based on the amount of cryptocurrency staked by the Client. The payout percentages strictly depend on the type of the staked cryptocurrency, and this information is available on the homepage of the Website under the “Coins” section.

Client Rights and Obligations

You as a Client of the Company must cover all applicable taxes associated with staking payouts, which may be the subject of the official taxation process in different jurisdictions. In this case, the Validatrium is not responsible for any Client taxes that were imposed by different legislation systems.

If you want to initiate the withdrawal process, then you have to wait until the Unbounding Period whose length strictly depends on a particular Blockchain network. It’s important to mention that you won’t be able to withdraw your staked cryptocurrency before the Unbouding Period.

Representations and Warranties

Each party represents and warrants to the other Party that: (i) it is duly organized, validly existing, and in good standing under its jurisdiction of organization and has the right to enter into these Terms of Use; (ii) the execution, delivery, and performance of these Terms of Use and the consummation of the transactions contemplated hereby are within the corporate powers of such Party and have been duly authorized by all necessary corporate action on the part of such Party, and constitute a valid and binding agreement of such Party; (iii) it has the full power, authority, and right to perform its obligations and grant the rights it grants hereunder; and (iv) its performance under these Terms of Use shall comply with all applicable laws, rules, and regulations, including, without limitation, all applicable national and international laws, regulations, notices, and guidelines relating to information privacy.

Prohibition of Use

BY ACCESSING AND USING Validatrium SERVICES, YOU REPRESENT AND WARRANT THAT YOU HAVE NOT BEEN INCLUDED IN ANY TRADE EMBARGOES OR ECONOMIC SANCTIONS LIST (SUCH AS THE UNITED NATIONS SECURITY COUNCIL SANCTIONS LIST), THE LIST OF SPECIALLY DESIGNATED NATIONALS MAINTAINED BY OFAC (THE OFFICE OF FOREIGN ASSETS CONTROL OF THE U.S. DEPARTMENT OF THE TREASURY), HAVE NOT BEEN DESIGNATED BY THE U.S. GOVERNMENT AS A “TERRORIST SUPPORTING” JURISDICTION, HAVE NOT BEEN INCLUDED IN THE DENIED PERSONS OR ENTITY LIST OF THE U.S. DEPARTMENT OF COMMERCE OR THAT YOU ARE NOT LISTED ON ANY U.S. GOVERNMENT LIST OF PROHIBITED OR RESTRICTED PARTIES.

Validatrium RESERVES THE RIGHT TO CHOOSE MARKETS AND JURISDICTIONS TO CONDUCT BUSINESS, AND MAY RESTRICT OR REFUSE, IN ITS DISCRETION, THE PROVISION OF Validatrium SERVICES IN CERTAIN JURISDICTIONS.

Please note that there are legal requirements in various jurisdictions which may restrict the products and services that Validatrium can lawfully provide. Accordingly, some products and services and certain functionality within the Validatrium Services may not be available or may be restricted in certain jurisdictions or regions or to certain users.

You shall be responsible for informing yourself about and observing any restrictions and/or requirements imposed with respect to the access to and use of the Validatrium Services in each jurisdiction from which the Validatrium Services are accessed by you or on your behalf. Validatrium reserve the right to change, modify or impose additional restrictions with respect to the access to and use of the Validatrium Services from time to time at Our discretion at any time without prior notification.

Limitation of Liability

NO PARTY TO THE TERMS WILL BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA OR GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE OR SYSTEM FAILURE, OR THE COST OF SUBSTITUTE SERVICES ARISING OUT OF OR IN CONNECTION WITH THE TERMS OR FROM THE USE OF OR INABILITY TO USE THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT SUCH PARTY HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL CLIENT’S OR COMPANY’S TOTAL LIABILITY TO THE OTHER ARISING OUT OF OR IN CONNECTION WITH THE TERMS OR FROM THE USE OF OR INABILITY TO USE THE SERVICES EXCEED THE AMOUNTS PAID OR PAYABLE BY CLIENT TO COMPANY FOR USE OF THE SERVICES DURING THE TWELVE (12) MONTH PERIOD PRIOR TO THE DATE WHEN THE CLAIM OR LIABILITY FIRST AROSE.

Compliance with Laws/Copyright

Each party shall comply with all Applicable Law in connection with the performance of its obligations and the exercise of its rights in the Services. Without limiting the foregoing, Company respects copyright law in all jurisdictions in which it does business and expects its Clients to do the same. It is Company’s right to terminate, in appropriate circumstances, Clients, which infringe or are believed to be infringing the rights of copyright holders.

Confidential Information and Confidentiality Obligations

Company understands that it may receive confidential information of Client and Client understands that it may receive confidential information of Company. The receiving party agrees not to divulge to any third party any confidential information of another party and not to use any confidential information of another party for any purpose not contemplated by the Terms.
